I-140 Immigrant Petition

The I-140 Immigrant Petition for Alien Worker is a petition filed by the employer on behalf of an alien worker to become a permanent resident in the United States. This petition is usually filed within 180 days from the date a Labor Certification approval by the U. S. Department of Labor. An I-140 Petition may be filed without a Labor Certification where the beneficiary qualifies under EB-1 classification.

I-485 Principal Applicant

Adjustment of Status Application Form I-485 is used by a person in the United States to apply for lawful permanent resident status. You can file this application as the Principal Applicant if you are named as the beneficiary of an I-140 immigrant petition or who is otherwise qualified to adjust status.

Derivative Applicant is the principal applicant’s spouse and children, who are not beneficiaries of their own immigrant petition and may be eligible to apply for adjustment of status under the same immigrant category as the principal applicant.
